Key Clauses to Include
While the 14-Day Trial waives the standard monthly membership fee, the Member remains liable for all Third-Party Costs (including but not limited to booking fees, tickets, reservations, deposits, and goods purchased on the Member’s behalf) and Administrative Execution Fees incurred during the trial period.
Should the Member cancel their membership during the 14-Day Trial, any funds allocated to 'Service Execution' or 'Research Time' that has already been utilised are non-refundable. Refunds only apply to unutilised retainer balances not yet assigned to a specific request.
Limitation of Liability for Third Parties
Xplora Luxe acts only as an intermediary for third-party service providers. We assume no liability for the acts, omissions, or bankruptcies of such providers. All bookings made during the trial period are subject to the terms and conditions of the third-party supplier.
Cancellation & Late Fees
Requests cancelled by the Member with less than 24 hours' notice (or outside the cancellation window of the third-party vendor) will incur a Cancellation Fee equal to the total cost of the booking or AED 200, whichever is greater.
By requesting specific services (e.g., booking tables, purchasing tickets,etc) during the trial period, you acknowledge that the performance of these personalised services begins immediately and waive the standard 14-day cooling-off period.
- Navigator (Entry Level): Lifestyle team available for travel design
- Meridian(Mid-Tier): The 14-day trial covers up to 5 service requests or up to 2 hours of concierge research time. Once the allocated time or services exceed the limit, immediate upgrade will be required.
- Zenith: We require a refundable retainer of AED 5,000 before the trial starts.

Please read these Terms and Conditions carefully before activating your Xplora Luxe membership. By completing your subscription, you confirm that you have read, understood and agreed to be bound by these terms in their entirety. These terms constitute a legally binding agreement between you and Xplora Luxe FZ-LLC, a company registered in the UAE.

1. DEFINITIONS
1.1 "Xplora Luxe", "we", "us" or "our" refers to Xplora Luxe FZ-LLC, a company duly registered and licensed in the United Arab Emirates.
1.2 "Member" or "you" refers to any individual or entity that has subscribed to an Xplora Luxe membership tier and whose subscription payment has been successfully processed.
1.3 "Membership" means the active subscription to one of the Navigator, Meridian or Zenith tiers as selected at the time of enrolment.
1.4 "Monthly Subscription" means a recurring membership billed on a calendar-month basis, renewing automatically on the same date each month unless cancelled in accordance with Clause 5.
1.5 "Annual Subscription" means a membership commitment paid in advance for a full twelve-month period, at a 20% discount to the equivalent monthly rate, as set out in the tier schedule above.
1.6 "Membership Benefits" means the specific services, allowances, discounts and privileges associated with the Member's elected tier as described on the Xplora Luxe website at the time of enrolment. Benefits are subject to availability and supplier terms.
1.7 "Billing Date" means the date on which your subscription payment is first processed, which shall serve as the recurring monthly renewal date for Monthly Subscriptions.
1.8 "Notice Period" means the 30-day written cancellation notice required under Clause 5.2.
2. MEMBERSHIP ENROLMENT & ACTIVATION
2.1 Membership is available to individuals aged 18 years or over and to corporate entities with an authorised signatory. Xplora Luxe reserves the right to accept or decline any membership application at its sole discretion.
2.2 Your membership is activated upon successful processing of your first subscription payment. You will receive written confirmation of activation to your registered email address within 24 hours.
2.3 Membership is personal and non-transferable. You may not assign, sublicense or transfer your membership or any of the associated benefits to any third party without prior written consent from Xplora Luxe.
2.4 You are responsible for ensuring that all personal information provided at enrolment is accurate, current and complete. Xplora Luxe accepts no liability for service failures arising from inaccurate member information.
2.5 Membership at any tier does not constitute a guarantee of availability of any specific service, experience or supplier. All benefits are subject to availability and third-party supplier terms and conditions.
3. BILLING, PAYMENT & PRICING
3.1 All membership fees are quoted and charged in UAE Dirhams (AED) and are inclusive of applicable VAT where required under UAE Federal Decree-Law No. 8 of 2017 on Value Added Tax.
3.2 Monthly Subscriptions are billed automatically on your Billing Date each month. Annual Subscriptions are billed in a single upfront payment at enrolment.
3.3 Payment is collected via the secure payment gateway integrated into the Xplora Luxe platform. Accepted payment methods include major credit and debit cards. Xplora Luxe does not store full card details; all payment data is handled by our PCI-DSS compliant payment processor.
3.4 If a scheduled payment fails for any reason, Xplora Luxe will notify you by email and attempt to collect payment again within 3 business days. If payment remains unsuccessful after two attempts, your membership will be suspended and access to Membership Benefits will be paused until the outstanding amount is settled.
3.5 Xplora Luxe reserves the right to revise membership pricing with no less than 60 days' written notice to existing Members. Any pricing change will not take effect until your next renewal date following the expiry of that notice period. If you do not wish to continue at the revised price, you may cancel your membership in accordance with Clause 5 within the notice period without penalty.
3.6 Annual Subscription pricing is fixed for the full twelve-month term and will not be subject to mid-term price increases.
3.7 Service costs for curated experiences, private aviation, yacht charters, fine dining and other third-party bookings made through Xplora Luxe are charged separately from your membership fee and are subject to the individual service terms quoted at the time of booking.
4. MEMBERSHIP BENEFITS & SERVICE DELIVERY
4.1 The specific benefits associated with each membership tier are as set out on the Xplora Luxe website and in your membership confirmation at the time of enrolment. Xplora Luxe may update or enhance Membership Benefits from time to time; any such changes will be communicated to Members no less than 30 days in advance.
4.2 Complimentary benefits (including but not limited to airport fast-track bookings, desert safari inclusions, fine dining vouchers and yacht charter allowances) are allocated per membership year and do not carry over to the following year if unused. Complimentary benefits have no cash value and cannot be exchanged, gifted or redeemed for credit.
4.3 Member discounts on experiences are applied at the time of booking confirmation and are subject to the availability of the applicable experience or supplier. Discounts are applied to the net service cost before VAT and do not apply to private jet charter services unless expressly stated.
4.4 Xplora Luxe acts as a coordination and advisory intermediary. We do not own, operate or bear direct liability for the services delivered by third-party suppliers including aviation operators, hospitality providers, yacht charter companies and experience operators. Member interactions with third-party suppliers are subject to those suppliers' own terms and conditions.
4.5 While Xplora Luxe exercises rigorous vetting standards across its supplier network, we cannot guarantee the performance of third-party suppliers. In the event of a third-party service failure, Xplora Luxe will use reasonable endeavours to arrange an alternative service or remedy on the Member's behalf.
4.6 Access to Membership Benefits is conditional on your membership account being in good standing, with no outstanding payments or material breaches of these Terms and Conditions.
5. CANCELLATION POLICY
Xplora Luxe operates a 30-day written notice cancellation policy. This applies to both Monthly and Annual Subscriptions as set out below.
5.1 MONTHLY SUBSCRIPTIONS — RIGHT TO CANCEL: You may cancel your Monthly Subscription at any time by providing written notice to Xplora Luxe via the methods set out in Clause 5.6. Your cancellation will take effect at the end of the 30-day notice period, calculated from the date your written notice is received and acknowledged by Xplora Luxe.
5.2 MONTHLY SUBSCRIPTIONS — BILLING DURING NOTICE PERIOD: You will continue to have full access to all Membership Benefits during the 30-day notice period. If your Billing Date falls within the notice period, you will be charged your standard monthly membership fee for that final month. No partial-month refunds are issued for Monthly Subscriptions.
5.3 ANNUAL SUBSCRIPTIONS — CANCELLATION TERMS: Annual Subscriptions represent a full twelve-month financial commitment. If you wish to cancel an Annual Subscription before the end of the twelve-month term, you must provide 30 days' written notice before expiry of the membership. Upon cancellation of an Annual Subscription: (a) membership access will continue until the end of the 30-day notice period; (b) the remaining prepaid months are forfeited and are non-refundable, except in the circumstances set out in Clause 5.5; (c) any complimentary benefits already utilised during the membership year will be deducted at the standard non-member rate from any credit due under Clause 5.5.
5.4 ANNUAL SUBSCRIPTIONS — RENEWAL: Annual Subscriptions do not renew automatically unless the Member opts into auto-renewal at the time of enrolment or subsequently elects to do so in writing. Members will receive a renewal reminder no less than 30 days before their Annual Subscription expiry date.
5.5 EXCEPTIONAL CIRCUMSTANCES — REFUND CONSIDERATION: Xplora Luxe may, entirely at its discretion, consider a pro-rata refund of prepaid Annual Subscription fees in the following exceptional circumstances only: (a) the Member provides documented evidence of a serious medical condition that prevents ongoing use of the membership; (b) the Member is required to permanently relocate outside the GCC region for professional reasons, supported by employer documentation; (c) Xplora Luxe materially fails to deliver the core Membership Benefits for a continuous period exceeding 60 days and the failure is not attributable to third-party supplier disruption. Requests under this clause must be submitted in writing within 30 days of the qualifying event.
5.6 HOW TO SUBMIT A CANCELLATION REQUEST: All cancellation requests must be submitted in writing using one of the following methods: (a) by email to [email protected] with the subject line 'Membership Cancellation — [Your Full Name] — [Tier]'; (b) through the cancellation request form in your Member Portal on the Xplora Luxe platform. Verbal cancellation requests — including telephone requests — will not be accepted and will not initiate the notice period. Xplora Luxe will acknowledge receipt of your cancellation request in writing within 2 business days, confirming your final membership date.
5.7 TIER DOWNGRADE: A Member wishing to move from a higher tier to a lower tier may do so by submitting a written request. Downgrades take effect from the next Billing Date following receipt of the request. No refund is issued for the difference in tier cost in the current billing month.
5.8 TIER UPGRADE: A Member wishing to upgrade to a higher tier may do so at any time. An upgrade takes effect immediately upon payment of the pro-rata difference for the current billing month, with the full upgraded tier fee applying from the following Billing Date.
6 SUSPENSION & TERMINATION BY XPLORA LUXE
6.1 Xplora Luxe reserves the right to suspend or terminate a membership immediately and without liability in the following circumstances: (a) non-payment of membership fees after two failed collection attempts; (b) material breach of these Terms and Conditions that is not remedied within 14 days of written notice; (c) conduct that, in the reasonable opinion of Xplora Luxe, is abusive, threatening or damaging to Xplora Luxe staff, suppliers or other Members; (d) provision of false or fraudulent information at enrolment or during the membership.
6.2 In the event of termination under Clause 6.1, no refund of membership fees will be issued for any prepaid period.
6.3 Xplora Luxe reserves the right to discontinue a specific membership tier or to wind down its membership programme entirely with no less than 90 days' written notice to affected Members. In such circumstances, Xplora Luxe will issue a pro-rata refund of any prepaid Annual Subscription fees for the unused portion of the membership term.
7. CONFIDENTIALITY & DATA PRIVACY
7.1 Xplora Luxe treats Member information with the utmost discretion. We do not share, sell or disclose Member data to third parties except: (a) to vetted suppliers to the extent necessary to fulfil a specific service request; (b) as required by applicable UAE law or regulatory authority; (c) with the Member's explicit prior consent.
7.2 Xplora Luxe processes Member personal data in accordance with UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (PDPL). Our full Privacy Policy is available on the Xplora Luxe website and forms part of these Terms and Conditions.
7.3 Members consent to Xplora Luxe maintaining a curated profile of their preferences, lifestyle requirements and service history (the "XL Profile") for the purpose of delivering personalised concierge services. Members may request access to, correction of, or deletion of their XL Profile data at any time in writing.
7.4 Upon cancellation or termination of membership, Xplora Luxe will retain Member data for a period of 7 years in accordance with UAE commercial record-keeping requirements, after which it will be securely deleted unless otherwise required by law.
8. LIMITATION OF LIABILITY
8.1 To the fullest extent permitted by applicable UAE law, Xplora Luxe's total aggregate liability to a Member in respect of any claim arising out of or in connection with these Terms and Conditions shall not exceed the total membership fees paid by that Member in the twelve months immediately preceding the event giving rise to the claim.
8.2 Xplora Luxe shall not be liable for: (a) any indirect, incidental, consequential or punitive loss or damage; (b) loss of enjoyment, opportunity or anticipated experience; (c) any loss or damage arising from the act or omission of a third-party supplier; (d) any delay or failure to perform resulting from a Force Majeure Event as defined in Clause 9.
8.3 Nothing in these Terms and Conditions shall limit or exclude liability for death or personal injury caused by Xplora Luxe's negligence, or for fraud or fraudulent misrepresentation.
9. FORCE MAJEURE
9.1 A "Force Majeure Event" means any event beyond the reasonable control of Xplora Luxe, including but not limited to acts of God, natural disasters, pandemic or epidemic, acts of government or regulatory authority, war, civil unrest, terrorism, widespread infrastructure failure, or any other event that renders performance impossible or commercially impracticable.
9.2 In the event of a Force Majeure Event, Xplora Luxe's obligations under these Terms and Conditions shall be suspended for the duration of that event. Xplora Luxe will notify Members as soon as reasonably practicable and will use reasonable endeavours to resume normal service delivery.
9.3 If a Force Majeure Event results in Xplora Luxe being unable to deliver core Membership Benefits for a continuous period exceeding 60 days, Members may request a pro-rata suspension credit for the affected period, to be applied to the next billing cycle.
10. GOVERNING LAW & DISPUTE RESOLUTION
10.1 These Terms and Conditions are governed by and construed in accordance with the laws of the United Arab Emirates, and where applicable, the regulations of the relevant free zone authority under which Xplora Luxe is registered.
10.2 In the event of any dispute arising out of or in connection with these Terms and Conditions, both parties agree to first seek resolution through good-faith direct negotiation. A Member wishing to raise a formal dispute should contact Xplora Luxe in writing at [email protected].
10.3 If a dispute cannot be resolved through negotiation within 30 days of written notice, the dispute shall be referred to and finally resolved by the courts of the UAE having jurisdiction, or such alternative dispute resolution mechanism as both parties may mutually agree.
11. GENERAL PROVISIONS
11.1 ENTIRE AGREEMENT: These Terms and Conditions, together with the Privacy Policy and any membership confirmation issued to you, constitute the entire agreement between you and Xplora Luxe in relation to your membership and supersede all prior representations, agreements and understandings.
11.2 AMENDMENTS: Xplora Luxe may update these Terms and Conditions from time to time. Material changes will be communicated to Members by email no less than 30 days before they take effect. Your continued use of the membership after that date constitutes acceptance of the updated terms.
11.3 SEVERABILITY: If any provision of these Terms and Conditions is found to be unlawful, void or unenforceable, that provision shall be severed, and the remaining provisions shall continue in full force and effect.
11.4 WAIVER: Any failure by Xplora Luxe to enforce a provision of these Terms and Conditions shall not constitute a waiver of the right to enforce that provision at any future time.
11.5 NOTICES: All formal notices from Xplora Luxe to Members will be sent to the registered email address on the Member's account. It is the Member's responsibility to keep their contact details current.
